Terms of Sale

These terms apply when you buy an artmoovik on sendajoy.com. By paying, you agree to them. If something here is unclear, write to hello@sendajoy.com before you pay.

1. Who we are

Sendajoy is the shop of the artist Kir Klend, who makes artmooviks: one-of-a-kind works where a painting appears stroke by stroke, drawn by code, to a song written for one person. In these terms “we” and “us” mean Kir Klend and Sendajoy; “you” means the buyer. Contact: hello@sendajoy.com.

2. What you buy

• An artmoovik from the gallery ($35): a finished work shown on the gallery wall, personalised with the names you enter (For / From) and your letter.
• An artmoovik made for you, including portraits ($25): a new work painted around your story, with a new song.

You receive a private link to a gift page with the recipient’s name, the artmoovik with its song, your letter and a numbered certificate (“One of one · № …”). It is a digital product; nothing is shipped. With it comes the artmoovik as a 1 of 1 token (NFT) on the Base network — the painting and its song, without names or letter. To receive it, email your wallet address to hello@sendajoy.com. If the token is resold, the new owner gets the artmoovik (painting and song); the private gift page with names and letter stays with the original recipient. The token is a collectible, not an investment, and we do not promise any resale value.

The painting is drawn by code, stroke by stroke. The artist creates the idea, the images and the story; the words and the music are made with AI.

3. Edition of one

Each artmoovik is sold once. After the sale we remove it from the gallery and from our Instagram, and we do not paint, sell or publish it again, or publish your personalised gift page, without your permission.

4. Ordering a gallery piece

• When you press “Buy and pay”, the piece is held for you for 30 minutes and you get an exact amount to pay (for example 35.43 USDT). The exact amount is how we recognise your payment.
• After the payment is confirmed on the blockchain (usually within a few minutes), the gift link appears on the page, and by email if you gave one. Save the link: anyone who has it can open the gift page.
• Please check the names and the letter on the preview before paying. After the link is issued we can fix small typos on request, but the piece itself cannot be exchanged.

5. Custom artmooviks and portraits

• The price is $25, paid in full when you order.
• We send the first sketch to your email, usually within 24 hours of the payment. If it is not right, we redo it once.
• For a portrait you send us a photo. Send only photos you have the right to use, and only of people who agree to be painted.
• If you do not approve the sketch after the redo, the order ends there: the payment is kept as payment for the work done, and you owe nothing more.
• We may decline a request (see section 7). If we decline after you paid the payment, we return the payment in full.

6. Payment

• We accept USDT on the Ethereum network (ERC-20). USDT is sent to the wallet address shown on the payment panel; network fees are paid by the sender.
• Send the exact amount in one transfer. If you send a different amount, or pay after the hold has ended, write to us with the transaction link and we will sort it out by hand: deliver your piece if it is still available, or return the money.
• Payments sent in another token or on another network may be impossible to recover. We will try to help, but cannot promise to.
• If we return money, the payment is sent back in USDT (ERC-20) to the address it came from, minus the network fee.

7. What we will not make

We will not make works with content that is illegal, hateful or sexual, that targets or harasses someone, or that uses another person’s name, photo or words without their right to do so. We may decline any request we cannot make well.

8. Rights

The artist keeps the copyright in every artmoovik, its painting, lyrics and code. You and the person you give it to may watch it, keep the link, share it privately and post it on your personal social media with credit to Kir Klend. You may not sell it, use it in advertising or resell the link without our written permission.

You keep the rights to your own letter and photos. You allow us to use them only to make and show your gift.

9. The gift page

We intend to keep gift pages online for as long as Sendajoy exists. If we ever have to take a page offline, we will write to you at least 60 days before (if you gave us an email) and give you a way to download the video.

10. Liability

We do our best to keep the shop and the gift pages working, but we cannot promise they will never be interrupted. Our total responsibility for any order is limited to the amount you paid for it. Nothing in these terms limits rights you have under the consumer law that applies to you.

We may update these terms. The version that applies to your order is the one shown on this page when you paid.
